OnePass

Welcome to OnePass, a membership program offered by Wesfarmers One Pass Pty Ltd (ABN 39 650 854 845). These OnePass Terms and Conditions (T&Cs) explain our obligations as a program provider and your obligations as an account holder and, if you purchase a membership, as a OnePass Member. Please read them carefully.

By registering and using OnePass, you acknowledge you have read and understood, and you agree to, these T&Cs.

The T&Cs apply to any use of the OnePass program including your Account, your Membership, any purchase of goods or services from us through your Account and your use of OnePass rewards or promotional/referral codes. The T&Cs apply to you from the time you open an Account and we provide you with access to OnePass.

The OnePass program will evolve and so these T&Cs may change over time. We reserve the right to change these T&Cs at any time in accordance with clause 6. It is your obligation to ensure you have read, understood and agree to the most recent T&Cs made available to you.

These T&Cs were last updated in 30 July 2024.

1. Definitions
  • '5x Flybuys Points Retailers’ means Kmart, Target, Bunnings Warehouse and Officeworks.
  • Account’ or ‘OnePass Account’ means a OnePass account accessed through OnePass.com.au.
  • Account Holder’ or ‘OnePass Member’ means a person who has registered to use OnePass and opened an Account.
  • us’, ‘we’ and ‘our’ means Wesfarmers One Pass Pty Ltd (ABN 39 650 854 845).
  • Member’ or ‘OnePass Member’ means an Account Holder who has subscribed to a OnePass Membership.
  • Member Benefits’ means the benefits offered to OnePass Members from time to time by certain Participating Brands and OnePass Partners, including the Member Benefits available as set out in clause 5. Not all Participating Brands and OnePass Partners offer all Member Benefits. See Member Benefits (clause 5) for further details.
  • Membership’ means the OnePass membership program made available by us entitling an Account Holder who has subscribed to OnePass and paid the Membership Fee for the relevant period (or otherwise been provided with Membership by us) to the Member Benefits.
  • Membership Fee means the fee charged by us for purchasing a Membership as varied from time to time (but does not include any additional fees for optional features we make available from time to time).
  • OnePass' means the OnePass program made available by us including any Membership you have purchased.
  • OnePass Partners’ means the businesses we have partnered with to bring additional features and Member Benefits to Members from time to time, including Flybuys.
  • Participating Brands’ means Kmart, Target, Bunnings Warehouse, Officeworks, Priceline, InstantScripts and Catch.com.au and any other businesses we have determined are participating in the OnePass program and offering Member Benefits and any other benefits to Members and/or Account Holders from time to time, but excluding OnePass Partners.
  • T&Cs’ means the terms and conditions set out or referenced above and below as amended or replaced from time to time.
  • Website’ means the Internet site at the domain OnePass.com.au or any other website operated by us and includes any OnePass App.
  • You’ andyour’ means the OnePass Account Holder who has been through the registration process set out below and agreed to these T&Cs.
2. OnePass Account eligibility and registration

To be eligible to obtain a OnePass Account (and become a Member) you must:

  1. be at least 18 years old;
  2. have a current Australian residential address;
  3. complete the registration process including:

    (1) providing your personal information requested by us during the registration process (including your name and contact details);
    (2) agreeing to these T&Cs; and
  4. be permitted by us (in our complete discretion) to access and use OnePass, through us enabling your access to OnePass.

Provided you meet the eligibility criteria, upon completing the registration process, you will have a OnePass Account on and subject to these T&Cs.

If you subscribe for a OnePass Membership (by paying the applicable Membership Fee or agreeing to a free trial) your Membership is governed by these T&Cs.

We may refuse an Account (or any Membership) at our discretion. Where we refuse a Membership (at or within a reasonable time after the commencement of the Membership), you will be provided with a full refund of any Membership Fee paid by you.

3. Free Trial
  1. From time to time, we may offer the opportunity for Account Holders to acquire a Membership on a limited period free-trial basis.
  2. In order to be eligible for a OnePass Membership on a free trial basis, you must be a new OnePass Account Holder (i.e. you do not have a current Account or Membership and have not previously had a OnePass Membership, whether paid or through a free trial) and you must meet the eligibility criteria in clause 2 above. Free trials are linked to a single OnePass Account and we may require you to provide a telephone number and credit card. The same telephone number and/or credit card cannot be used for a free trial on another Account if it has already been used in connection with a free trial.
  3. You may access a free trial one time only.
  4. Nothing in these T&Cs obliges us to offer a Membership on a free trial basis to you, even if you meet the eligibility criteria set out in clause 3(b).
  5. By acquiring a Membership on a free trial basis, you will be eligible for OnePass Member Benefits for 30 days from the day you register (or for such other period as we may offer to you in writing from time to time).
  6. You may cancel your free trial at any time during the free trial period. If you do so:

    (1) you will not be charged the Membership Fee; and
    (2) your access to Member Benefits will finish at the end of the free trial period.
  7. If we require you to provide a credit card to access the free trial, at the end of the free trial period, if you have not cancelled your free trial, you will automatically commence a monthly or annual Membership (depending on the Membership plan you have chosen at the time of signing up) which will be charged to the credit card provided or the payment method you nominate from time to time. If you have not provided your credit card information during your free trial, your access to Member Benefits will finish at the end of the free trial period.

4. Membership plans and the Membership Fee

4.1 Payment of your Membership Fee

  1. This clause applies after your free trial has ended and you have not cancelled your Membership prior to the end of the 30-day free trial period.
  2. By paying the Membership Fee to purchase a Membership, you are agreeing to an ongoing OnePass membership plan which will be billed in advance either monthly or annually, depending on the type of Membership plan you have selected.  
  3. Once purchased, your Membership will continue until you cancel your Membership or until the termination of your Membership (and/or the accompanying Account) in accordance with these T&Cs.
  4. You are responsible for keeping your payment details up to date within your Account settings. If any payment of the Membership Fee is not successfully authorised due to expiration, insufficient funds or any other reason, we may terminate your Membership effective from the end of your then current paid monthly or annual Membership plan.  

4.2 Monthly Membership

  1. A monthly Membership plan entitles you to receive OnePass Member Benefits for one month following the date your monthly Membership commences.
  2. Your monthly Membership plan will be automatically renewed unless cancelled by you prior to your Membership renewal date. The Membership renewal date for monthly Memberships is the date one calendar month after you purchased your monthly Membership, or your previous renewal date.

4.3 Annual Membership

  1. An annual Membership plan entitles you to receive OnePass Member Benefits for one year from the date your annual Membership commences.
  2. Your annual Membership plan will be automatically renewed unless cancelled by you prior to your Membership renewal date. The renewal date for annual Memberships is the date one year after you purchased your annual Membership or previous renewal date.

5. Member Benefits and Exclusions

5.1     Member Benefits

  1. Being a Member of OnePass entitles you to our Member Benefits. We may also offer additional benefits and offers to Members and Account Holders from time to time.
  2. In order to access and use the Member Benefits online with a Participating Brand, you must be logged into your OnePass Account and have linked your OnePass Account to the relevant Participating Brand or OnePass Partner.
  3. Member Benefits are not available in conjunction with Bunnings Warehouse PowerPass or with Officeworks Business2Business accounts or offers.

5.2     Free Standard Delivery

  1. Members are entitled to free standard delivery within Australia at Participating Brands on eligible items or orders. Participating Brands may exclude certain postcodes from the free standard delivery benefit.
  2. There is no minimum spend for Members to access the free standard delivery benefit.
  3. Eligible delivery locations are determined by each of the Participating Brands, and may exclude certain postcodes, rural and remote locations, and external territories including Norfolk Island, Christmas Island and the Australian Antarctic Territory from the free standard delivery benefit. To find out if your postal address is within an eligible delivery location, please refer to the website of the applicable Participating Brand.
  4. Participating Brands determine eligible items or orders for the purpose of the free standard delivery benefit. Eligible items may be marked at a Participating Brand’s website or shown at checkout. Items and orders excluded from the free standard delivery benefit are specified by Participating Brands and may include big, oversize and bulky items, items sold by third parties on a Participating Brand’s marketplace, or other items specified by Participating Brands from time to time. Check Participating Brands’ websites for details.
  5. Free delivery does not include express delivery, which may be made available by Participating Brands (in their complete discretion) for an additional fee and does not include delivery outside of Australia.

5.3     Collect 5x Flybuys points in-store at Participating Brands

  1. Members can collect 5x Flybuys points on purchases in-store only at 5x Flybuys Points Retailers (Kmart, Target, Bunnings Warehouse and Officeworks). 5x points equals 1 standard Flybuys point and 4 bonus Flybuys points per $1 spent. This equates to an additional 4 points per $1 spent on purchases in-store at 5x Flybuys Points Retailers. For the avoidance of doubt, Priceline, InstantScripts and Catch.com.au are not 5x Flybuys Points Retailers, and the 5xFlybuys points benefit is not available at Priceline, InstantScripts orCatch.com.au.
  2. You do not need to be a Flybuys member to become a OnePass Member. However, to collect Flybuys points (including 5x Flybuys points in-store at 5x Flybuys Points Retailers as a OnePass Member) you must first have a registered Flybuys account.
  3. To start collecting 5x Flybuys points in-store, OnePass Members must link their OnePass Account to their registered Flybuys account. Each OnePass Membership may only be linked with one Flybuys account. Eligibility to receive 5x Flybuys points in-store at 5x Flybuys Points Retailers is effective on the date a Member links their OnePass Account to their registered Flybuys Account. In-store purchases at 5x Flybuys Points Retailers prior to 11.59pm on the day the OnePass Account is linked to your registered Flybuys account will be eligible to receive the 5x Flybuys points benefit, provided your Flybuys card or digital OnePass card is scanned at the time of purchase in Bunnings and Officeworks, or your Flybuys card is scanned at the time of purchase in Target and Kmart.
  4. Members must scan their physical or digital Flybuys card in-store at the time of purchase at 5x Flybuys Points Retailers to collect Flybuys points. Please see Flybuys terms and conditions for further details on how to collect and redeem Flybuys points.
  5. 5x Flybuys points benefit is available on Click &Collect purchases at Kmart, Bunnings Warehouse and Officeworks. Others 5x Flybuys Points Retailers may extend the 5x Flybuys points benefit to eligible Click & Collect purchases. Check each 5x Flybuys Points Retailer’s website for details.
  6. The 5x Flybuys points in-store benefit is not available on any online orders and is not available at Priceline, InstantScripts or Catch.com.au. Alternative Flybuys points offers may be available at Catch.com.au. Please check the Catch.com.au website for details. The 5x Flybuys points in-store benefit is not available on Target transactions where instant Flybuys points redemption has been used at the time of purchase (including any remaining balance that is payable). This exclusion does not apply to transactions where Flybuys Dollars are redeemed.
  7. Flybuys points are calculated based on transaction balance after savings and discounts. 5x Flybuys Points Retailers Flybuys’ exclusions may apply. Refer to 5x Flybuys Points Retailers Flybuys terms and conditions.
  8. If you collect 5x Flybuys points on items purchased in-store, and those items are subsequently returned to the retailer and the price refunded to you, the Flybuys points collected in respect of those items will be deducted from your Flybuys account.
  9. Once you have linked your OnePass Account to your Flybuys account, any other cardholders on your Flybuys account will also be eligible for the 5x Flybuys points offer at 5x Flybuys Points Retailers.
  10. In most circumstances your collected Flybuys points will appear within your Flybuys account within 3 days after the eligible transaction is made.
  11. The Flybuys Terms and Conditions and Flybuys Privacy Policy apply to your use of Flybuys.

5.4     Express Click & Collect

  1. Members are able to access express click & collect on eligible items purchased at Kmart and Bunnings Warehouse. Please note express click & collect may be a standard offering to all customers at other Participating Brands.
  2. Express click & collect is only available if an item is in stock at the Member’s nominated store. Express click & collect is not available on online exclusives offered at Participating Brands and is not available at InstantScripts.
  3. Participating Brands may have additional limitations and exclusions, including for heavy or bulky items and may have same day cut-off times. Check Participating Brands’ websites for details.

5.5     365 day change of mind returns

  1. Members may return eligible items purchased online and in-store at certain Participating Brands for change of mind for up to 365 days from the date or purchase.
  2. The 365 day return benefit only applies to eligible items purchased by a Member at:

    (1) Kmart, Target, Officeworks and Catch.com.au from 5 September 2023; and
    (2) Priceline from 19 March 2024 (provided the Member’s OnePass Account has been linked to their Priceline Sister Club account at the time of purchase).
  3. Participating Brands’ change of mind returns policies apply to 365 day returns. Participating Brands may exclude or limit returns for certain items and categories of goods and require proof of original purchase. See the relevant Participating Brand’s website for details. Not available on marketplace items or gift cards.
  4. 365 day returns is not available at InstantScripts. An alternative returns offer is available to all customers at Bunnings Warehouse. Please check the Bunnings Warehouse website for details.
  5. The 365 day returns benefit for change of mind returns is in addition to your rights under the Australian Consumer Law.

5.6     Early Access

  1. From time to time we may also offer other exclusive benefits to Members, including early access to items or pricing at Participating Brands before that offer is available to the public.
  2. Offers are generally available for a limited time only. Please see Participating Brands websites for more information, including details of available offers and campaign periods.

5.7    Priceline Member Benefits

  • To be eligible for Priceline Member Benefits, Members must first have a registered Priceline Sister Club account and have linked that Priceline Sister Club account to their OnePass Account. Each OnePass Account may only be linked to one Priceline Sister Club account. Eligibility to receive Priceline Member Benefits is effective from the time the Member receives confirmation that their OnePass Account has been successfully linked to their registered Priceline Sister Club Account. Details of how to register for a Sister Club account can be found on the Priceline website here.
  • 2 Sister Club Points per $1 spent in-store: OnePass Members who are Sister Club tier members of Priceline’s Sister Club can collect 2 points for every $1 spent on eligible items and orders in-store at Priceline. This consists of 1 standard Sister Club point and 1 bonus Sister Club Point per $1 spent. This Member Benefit is only available in-store at Priceline and not available for online orders. Bonus Sister Club points are added to your Sister Club points balance but do not count towards your Sister Club tier status.
  • To receive bonus Sister Club points, OnePass Members must scan their Sister Club card or provide their Sister Club account details at the time of purchase. Please see the Priceline Sister Club terms for further details on how to collect and redeem Sister Club points.
  • The bonus Sister Club points Member Benefit only applies to Priceline Sister Club members whose membership is within the ‘Sister Club’ tier. Diamond and Pink Diamond tier Sister Club members are not eligible for bonus Sister Club points and will continue to earn 2 and 3 Sister Club points respectively per $1 spent.
  • Priceline may also offer additional benefits and offers to OnePass Members from time to time. Please see the Website for details.

5.8    InstantScripts Member Benefits

6. Changes to T&Cs, Fees and Member Benefits
  1. From time to time we may modify or change these T&Cs including the Member Benefits or the fees charged by us in relation to a OnePass Membership (including the Membership Fee).
  2. Changes to these T&Cs will be effective upon publication of the modified T&Cs on the Website. We will notify you of any material changes to these T&Cs in advance of them taking effect.
  3. If you have an existing Membership, the revised T&Cs will apply to you:

    - If you are on a Monthly Membership, from the date your monthly membership next renews; or
    - If you are on an Annual Membership, from the date which is 30 days after publication of the revised T&Cs.
  4. If you do not agree to the changes, you must cancel your Membership and/or close your Account.
  5. If you do not cancel your Membership and:

    - you have a Monthly Membership, the amended T&Cs will apply to you from your next monthly Membership renewal date; or
    - you have an Annual Membership, the amended T&Cs will apply to you from the date which is 30 days after publication of the revised T&Cs.
  6. If you have an Annual Membership and you cancel your Membership within 30 days after publication of the revised T&Cs, you can obtain a refund of the portion of the Membership Fee you paid (subject to clause 7(c)) which covers the remaining portion of your then current Annual Membership Period by contacting our Customer Service Centre on 1300 026 710.
  7. Without limiting this clause 6, we may, from time to time, make additional functionality, features or services available to Account Holders and/or Members for purchase and may charge you fees for such additional functionality, features or services if you elect to purchase or acquire them. Unless otherwise stated you must pay for the additional functionality, features or services referred to in this clause 6 prior to us making it available to you (or must pay for it in accordance with the payment terms notified to you).

7. OnePass promotions
  1. From time to time we may offer rewards and conduct promotions for Members and/or Account Holders, including by issuing promotional codes or referral codes. When participating in a promotion or redeeming a promotional code or referral code you must comply with these T&Cs and the offer terms applicable to that promotion, including any eligibility criteria.
  2. Promotional codes issued by OnePass are available for a limited time only, are non-transferable, cannot be redeemed for cash, and cannot be used in conjunction with other offers. Each promotional code applies only to the OnePass Membership specified in the offer terms, and can only be used once per person unless otherwise specified in the offer terms.
  3. If you purchase a Membership using a promotional code, and your Membership Fee is subsequently refunded for any reason, the amount refunded will be the Membership Fee less the promotional discount you received using the promotional code.
  4. We reserve the right to make changes to the way we conduct promotions from time to time at our discretion.
  5. Participating Brands and OnePass Partners may also conduct their own promotions or issue their own promotional codes, and in such circumstances the Participating Brand’s or OnePass Partner’s terms apply.

8. Your obligations
  1. You agree to use OnePass in accordance with these T&Cs.
  2. You must ensure the security and confidentiality of your Account and/or Member details, including any username and/or password assigned to, or created by, you and not share those details with anyone else.
  3. From time to time, we may require two-factor authentication to enable you to access your Account or obtain certain Member Benefits. When two-factor authentication is enabled, you will be required to enter an authentication code which will be sent to you by the preferred verification method you have selected. If you are unable to access your verification code, you will need to call our Customer Service Centre on 1300 026 710 to verify your account.
  4. You are wholly and solely responsible for all activities which occur through the use of your Account or Member details with knowledge of your username and/or password (including any transactions made through the Website or with Participating Brands, and any unauthorised use of credit cards or bank accounts) except as a result of our negligence, our breach of these T&Cs, or our breach of the Privacy Policy. If your negligence or breach of these T&Cs results in unauthorised access to your Account (or any account you have with a Participating Brand) then you will be responsible for the transactions conducted through your Account or your account with a Participating Brand as a result of the unauthorised access.
  5. You must promptly notify us if you become aware of any unauthorised access to your Account or any unauthorised use of your Membership details.
  6. You may not have more than one Account or Membership at a time. OnePass Membership is limited to a single Account and is not transferable. You must not allow your Account or Member details to be used by any other person.
  7. You must inform us if any of your personal details change (name or contact details).
  8. In accessing the Website or using your Account you must not engage in any inappropriate conduct, or conduct that is unlawful or is prohibited by any laws including:
    1. Any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual’s consent) or any other legal rights of individuals;
    2. Attempting to undermine the security or integrity of our systems or networks or, where the Websites are hosted by a third party, that third party’s computing systems and networks;
    3. Using, or misusing, the Website in any way which may impair:
      1. The functionality of the Website, or other systems used to deliver OnePass;
      2. The ability of any other Account Holder to use the Website; or
      3. The functionality or systems of Participating Brands used to deliver the benefits of OnePass;
    4. Any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual’s consent) or any other legal rights of individuals;
    5. Using any device or process to copy, adapt, disassemble, decompile, reverse engineer or in any way reproduce, modify or circumvent Website content, navigational structure, security or presentation of OnePass or any computer programs used to deliver OnePass or to operate the Website;
    6. Creating Accounts or OnePass Memberships fraudulently, under false pretences, or by automated means; and
    7. Using screen scraping, data mining or similar tools or attempt to copy any of the Website content or data available via the Website.
9. Unacceptable use of OnePass
  1. This clause provides guidance on the behaviour we consider to be acceptable and unacceptable use of the OnePass Program by Account Holders and Members. If we reasonably consider your use of OnePass is in breach of our acceptable use policy, we may cancel or terminate your Account (including any Membership), and may refuse to accept further Memberships through your Account, or new Accounts in your name.
  2. The OnePass Program is provided for your individual and personal use only. It is not to be used for commercial purposes, including to facilitate you selling any products or services to third parties.
  3. You must not sign up for or hold multiple OnePass Accounts or Memberships. You must not attempt to obtain and/or cancel multiple Memberships with the purpose of obtaining additional access to any Member Benefit offered on a ‘one-off’ basis.
  4. Without limiting any other provision of these T&Cs, we may cancel your Membership, or terminate your Account in whole or in part in the following circumstances:
    1. If we become aware, or reasonably believe, that you have provided false or in accurate information in order to register for OnePass;
    2. If you have failed to pay fees to us in relation to your OnePass Account (including the Membership Fee and any fees for additional content, services or goods);
    3. If you notify us that your Account has been accessed without your authorisation;
    4. We reasonably believe you have used your OnePass Account or Membership for commercial purposes;
    5. If your use of the Website breaches the T&Cs or you have used the Website in a fraudulent or improper manner; or
    6. If you are abusive or offensive to our employees or contractors, or the Participating Brands’ employees or contractors (whether in relation to your Account, Membership or otherwise).
  5. We have processes in place to assist us in detecting fraudulent and other illegal or improper transactions. If a transaction is flagged for these reasons, we will make enquiries into any potential fraud, illegal or improper transaction. If we are not satisfied a transaction is genuine, we may cancel your Membership and/or terminate your Account. Participating Brands and OnePass Partners may have similar processes in place.

10. Cancellation or Termination of Membership or Account

10.1    Cancellation of Membership by the Account Holder

  1. You can cancel your Membership at any time by logging into your Account and following the online instructions on how to cancel a Membership. Go to my.onepass.com.au/account/subscription-management and click Cancel Membership. If you need help to cancel your Membership you can contact our Customer Service centre anytime by calling our Customer Service Centre on ph: 1300 026 710.
  2. Your Membership cancellation will take effect at the end of your then current Membership period.
  3. Except as set out in clause 6(f) and clause 10.2(d), we do not refund or credit partially used billing periods.
  4. Your cancellation of your Membership does not automatically terminate your OnePass Account. You will still remain a OnePass Account Holder following cancellation of your Membership until you or we cancel or terminate your OnePass Account in accordance with these T&Cs.
  5. You may cancel your Account at any time by calling our Customer Service Centre on 1300 026 710. We will endeavour to process Account cancellations within seven days being notified of your cancellation. Cancelled Accounts cannot be reactivated.

10.2    Cancellation or termination of Membership or Account by OnePass

If you breach these T&Cs including, for example, by using OnePass for commercial purposes or by sharing your Membership with other people (regardless of whether they are Account Holders or Members or not), we may cancel your Membership and/or terminate your Account.

  1. Despite anything to the contrary in these T&Cs, where we validly cancel your Membership or terminate your Account for breach of these T&Cs, fees (including the Membership Fee) are not refundable.
  2. We will use reasonable endeavours to notify you if we have terminated your Membership or Account for any of the reasons set out in clause 9 or this clause 10.
  3. We also reserve the right to terminate your Membership at any time, without notice if we choose to stop providing the OnePass Program. In such circumstances we will refund (on a pro-rated basis) the pre-paid Membership Fee for the period following termination for which the Membership Fee relates (if any).

11. Warranties and Liability
  1. If you use OnePass as a consumer, then under the Australian Consumer Law :
    1. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law;
    2. To the maximum extent permitted by law, our guarantees to you are limited to those available to you under the Australian Consumer Law, as is our liability to you;
    3. If we fail to comply with a guarantee and our failure relates to goods or services supplied by or for us and is not a major failure, then you may require us to remedy the failure within a reasonable time, which we will do by (at our discretion):
      1. Replacing the goods or supplying equivalent goods or services;
      2. Repairing the goods;
      3. Refunding money paid by you for the goods or services or an amount equal to any other consideration provided by you for the goods.
  2. Without excluding, restricting or modifying the rights and remedies that you may be entitled to under the Australian Consumer Law consumer guarantees provisions (as referred to in clause 11.(a)(1) above), you acknowledge that:
    1. The OnePass Program (including Accounts and Memberships) is provided "as is" and without any express warranties or implied warranties as to OnePass' suitability for any particular purpose;
    2. To the maximum extent permitted by law in no event shall we, or any of our officers, directors, employees, agents or representatives otherwise be liable to you or any third party for any direct, indirect, special, punitive or consequential damages or losses arising from or in connection with your OnePass Account or Membership, or any other costs, losses or damages or any kind related to these T&Cs.
    3. To the maximum extent permitted by law our liability to you in relation to your OnePass Account or Membership is limited to the Membership Fees paid by you for the current or latest Membership period.
  3. Our liability to you for loss or damage of any kind arising out of, or in connection with, your use of OnePass or these T&Cs is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.
  4. For the sake of clarity, we are not responsible for the goods or services purchased by you from Participating Brands even if you receive a benefit from those Participating Brands as a result of you being a OnePass Member or Account Holder.
12. Website
  1. Access: Without limiting any other provision of these T&Cs:
    i) While we use reasonable endeavours to make the Website available to you, we do not guarantee, represent or warrant that your access to the Website will be uninterrupted, reliable, timely, secure or error free;
    ii) Access to the Website may be suspended without notice in the case of telecommunications interruption or bottleneck, system failure, maintenance or repair or any reason beyond our control (including services provided by third parties becoming unavailable).
  2. Links: The Website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

13. Intellectual Property
  1. Copyright in the Website and the content and materials on the Website are owned or licensed by us. You must not:
    (1) use, modify, adapt, reproduce, upload, sell, distribute or communicate any such content and materials; or
    (2) frame or embed in any other website and content or material appearing on the Website,

    in each case without our prior written consent.
  2. The Website contains trade marks which are protected by law. You must not use any trade mark appearing on the Website, including OnePass and the names and trade marks of Participating Brands and OnePass Partners without obtaining the consent of the relevant trade mark owner.

14. Privacy and personal information

Without limiting the content or application of our Privacy Policy (as updated from time to time), if you provide us with any personal information, our Privacy Policy governs how we will handle, use or disclose that information. Please review and understand our Privacy Policy for further information.

15. General
  1. Jurisdiction: These T&Cs are governed by the law of Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia in relation to any dispute relating to OnePass and these T&Cs.
  2. Waiver: The failure or delay on the part of any party in exercising any power or right conferred on it under these T&Cs will not operate as a waiver of the power or right, nor will any single exercise of any power or right preclude any other or future exercise of it, or the exercise of any other power or right under these T&Cs. Any waiver by a party will only be binding and effective if it is given in writing.
  3. Severance: If the whole or any part of a provision of the T&Cs is invalid, illegal or unenforceable, then such provision will be severed from the T&Cs and neither that part or provision or its severance will affect the validity or enforceability of the remaining parts or provisions of the T&Cs.
  4. In September 2023 we changed some of the terminology we use at OnePass. Customers who have a paid subscription/membership for OnePass are now known as OnePass Members (formerly referred to as OnePass Subscribers). We are aware Participating Brands’ and OnePass Partners’ websites may still occasionally refer to OnePass Members as ‘OnePass subscribers’. All references to OnePass subscribers on the Website and on Participating Brands and OnePass Partner websites should be read as references to OnePass Members.
  5. If we have provided you with a complementary OnePass Membership, these T&Cs apply to you as a OnePass Account Holder and Member as if you had paid the Membership Fee for your Membership.

16. Interpretation
  1. Headings are for convenience only, and do not affect interpretation. The following rules also apply in interpreting these T&Cs, except where the context makes it clear that a rule is not intended to apply.
  2. A reference to:
    1. legislation is to that legislation as amended, re-enacted or replaced, and includes any subordinate legislation issued under it
    2. “includes” means includes without limitation;
    3. a person includes any type of entity or body of persons, whether or not it is incorporated or has a separate legal identity, and any executor, administrator or successor in law of the person; and
    4. anything (including a right, obligation or concept) includes each part of it.
  3. A singular word includes the plural, and vice versa.
  4. A word which suggests one gender includes the other genders.
  5. If a word is defined, another part of speech has a corresponding meaning.
  6. Unless clearly indicated to the contrary words defined in the A New Tax System (Goods & Services Tax) Act 1999 (Cth) have the same meaning in these T&Cs.
  7. Charges for any goods or services supplied (or offered for supply) via us, including the Membership Fee are (unless otherwise stated) inclusive of GST.
