Terms and Conditions

1. The Competition is a game of chance and is authorised under the permits: ACT: TP 23/01323, SA: T23/1029, NSW: LTP/07186.
2. Information on how to enter forms part of the terms of entry. Entry into the OnePass – Subscribe. Shop. Win. with Disney and Target Competition 2023 (“Competition”) is deemed acceptance of these Terms and Conditions.
3. The material used to market and promote the Competition forms part of the Competition Terms and Conditions. If there is an inconsistency between the material used to market and promote the Competition and the Competition Terms and Conditions, the Competition Terms and Conditions prevail.
4. Promoter: The Promoter is Wesfarmers One Pass Pty Ltd (ABN 39 650 854 845) of Level 6, 699 Collins Street, Docklands, 3008, VIC and 1300 026 710 (“Promoter”).
5. Sponsor: The Walt Disney Company and each of its respective parent, affiliates and subsidiaries including The Walt Disney Company (Australia) Pty Ltd and their respective agents (“Sponsor”) is only responsible for providing the prizes to the Promoter for the purpose of this Competition. The Sponsor is not responsible to you for any aspect of this Competition, including its promotion, administration or execution.
6. Ansible: Ansible Pty Ltd (ABN 86 097 086 390) (Ansible) a division of Mediabrands Australia Pty Ltd, have been appointed to facilitate the Competition and the computerised prize draw.
7. Target: Target is a OnePass participating brand and for the purposes of this Competition is supporting by offering bonus entries into the Competition (Target Australia Pty Ltd (ABN 75 004 250 944) of 2 Kendall St, Williams Landing, VIC 3027.
   
   Competition Period
8. The Competition commences on Thursday, 14 September 2023 at ​07:01​ ​AEST​ and closes on ​Wednesday, 4 October 2023​ at ​23:59​ ​AEDT​ (“Competition Period”).
9. The Competition will be advertised on, but not limited to https://onepass.com.au/.
   
   Eligibility to Enter
10. During the Competition Period, anyone may enter the Competition, provided that they:
    are over 18 years of age;are a resident of Australia;are not an employee or immediate family member of an employee, of the Promoter or Target, or the Sponsor, who is directly associated and connected with the organisation of this Competition; andare available to complete the prize between 1 March 2024 to 31 December 2024. If the winner is unable to travel on these dates a re-draw will be conducted as per clause 19.
    
    How to Enter
11. To participate in the Competition entrants must:
    a. sign up to OnePass | Disney+ Bundle subscription, as a free trial or paid, or be an existing OnePass | Disney+ Bundle subscriber during the Competition Period, and have completed all required details as part of the sign-up process including, but not limited to, full name, e-mail address, mobile number, and payment details, to get one (1) automatic entry;
    b. be a paid OnePass | Disney+ Bundle subscriber at the time of the draw;
    c. to obtain bonus entries during the Competition Period, make purchases in-store or online at Target (Target.com.au) during the Competition Period; and
    d. at the time of the transaction, the eligible purchase is linked to or recorded in the entrant’s OnePass account activity history, by scanning the entrant’s OnePass membership card at the register or be logged into their OnePass account when checking out online at Target.com.au.
12. For clarity, all individuals who meet the Eligibility to Enter requirements under clause 10 and have successfully completed the How to Enter requirements in clause 11 will be deemed a valid entry (“Valid Entry”) and automatically entered into the Competition.
13. A limit of one (1) bonus entry per person, per day for online transactions at Target.com.au during the Competition Period applies. There is no limit to bonus entries for instore transactions at Target stores in Australia during the Competition Period.
14. The Promoter reserves the right, at any time, to verify the validity of entrants (including a subscriber’s identity, age, and place of residence) and to disqualify any subscribers who do not have a current subscription to the OnePass | Disney+ Bundle in accordance with these Terms and Conditions or who tampers with the sign-up process. Error and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
15. Signing up to the OnePass | Disney+ Bundle is subject to the OnePass | Disney+ Bundle Terms and Conditions available at https://onepass.com.au/terms-and-conditions.

    Drawing winners
16. The Prize Draw will be held on ​Friday, 20 October 2023​ at ​11:00​ ​AEDT​ at Ansible Pty Ltd, Level 3, 100 Chalmers Street, Surry Hills NSW 2010 via an electronic computerised draw.
17. The prize winners will be notified via phone or email by the Promoter within two (2) business days of the draw and the winners’ details including initial of first name, surname and postcode will be published on https://onepass.com.au/ from ​Tuesday, 24 October 2023​.
18. Upon notification, prize winner(s) must claim their prize by Thursday, 7 December 2023 (“Prize Claim Deadline”). Once a prize winner has accepted their prize, the Promoter will provide the prize winner’s details to the Sponsor within ten (10) business days of prize acceptance. Winners must deal directly with the Sponsor for prize fulfillment.
19. If for whatever reason any Prize is not claimed by the Prize Claim Deadline, or the entrant is deemed ineligible to enter the Competition and claim a Prize, a redraw will take place at Ansible Pty Ltd, Level 3, 100 Chalmers Street, Surry Hills NSW 2010 on ​Friday, 8 December 2023​ at ​10:00​ ​AEDT​ (“Unclaimed Prize Draw”). The prize redraw winner, if any, will be notified of their prize within two (2) business days by the Promoter via phone or email and the redraw winners’ details including initial of first name, surname and postcode will be published on https://onepass.com.au/ from ​Tuesday, 12 December 2023​.
20. Once an Unclaimed Prize Draw winner has accepted their prize, the Promoter will provide their details to the Sponsor within ten (10) business days of prize acceptance. Unclaimed Prize Draw winners must deal directly with the Sponsor or its nominated agent (as instructed by the Sponsor) for prize fulfillment.
21. If the Prize is not claimed as part of this Unclaimed Prize Draw, the Sponsor, in its sole discretion, will forfeit that Prize and no substitute will be offered.
    
    Prize details
22. There will be ten (10) individual prize winners drawn from the Valid Entries.
23. Each prize comprises a 4 night and 5 day AULANI Resort vacation package for up to four (4) guests as follows:
    a. Up to four (4) roundtrip economy airfares between the closest international airport near the prize winner’s residence (as determined solely by the Sponsor) (“Airport of Origin”) and Honolulu International Airport (on a flight route as determined solely by the Sponsor) (valued up to AUD $18,000.00).
    b. for the prize winner and up to three (3) guests (together with the prize winner, the “Group”).
    c. Any ground transfers or domestic flights between the prize winner’s place of residence and the Airport of Origin are not included in the Prize.
    d. Hotel accommodation consisting of one (1) standard room (with a maximum of four (4) persons per room) on a room only basis for the Group for four (4) nights at AULANI, A Disney Resort & Spa in Ko Olina, Hawaii (the “Resort”) (valued up to AUD $5,024.43).
    e. Resort credit for the amount of USD$1000.00 (One Thousand US Dollars) for use at the Resort (valued up to AUD $1,483.90).
    f. Ground Transportation to/from Honolulu International Airport and the Resort (valued up to AUD $593.56).
    g. Travel taxes imposed on ground and air transportation.The total prize pool per winner (excluding any ancillary travel costs applicable under clause 24(a)) is valued at up to AUD $25,000.00.

24. The Prize must not be booked during the block-out dates as follows:
    a. 1st January 2024 to 12th January 2024 inclusive,
    b. 12th February 2024 to 20th February 2024 inclusive,
    c. 25th March 2024 to 2nd April 2024 inclusive,
    d. 21st June 2024 to 9th August 2024 inclusive,
    e. 23rd November 2024 to 30th November 2024 inclusive, and
    f. 21st December to 31st December 2024 inclusive.
25. All Group members must travel together on the same itinerary and the same class of travel. Travel arrangements must be made through the Sponsor and on carriers selected by the Sponsor.
26. The trip must be booked at least 60 days in advance of travel departure date, and in any event, on or before 30 September, 2024. Travel must occur between 1 March 2024 and 31 December 2024 excluding any block-out dates (set out at clause 24 ). Travel dates are subject to availability. Flight details are subject to availability and airline carrier’s regulations and conditions apply. If travel is not booked by 30 September 2024 or the stay at the Resort is not completed by 31 December 2024, the Prize will be forfeited without compensation of any kind. No changes will be made to travel details once any element(s) of the travel arrangements have been booked except at the Sponsor’s sole discretion.
27. The prize winner is required to have and present at least one valid major credit card with available funds, or provide a cash deposit in order to check-in.
28. Expenses not included as part of the Prize are the sole responsibility of the prize winner, including: meals; excursions; alcoholic beverages; parking; laundry service; spa services; room service; local or long distance telephone calls; merchandise and souvenirs; tips and gratuities or service charges; airline baggage fees; travel insurance; incidental expenses; income and other taxes not specifically included; select AULANI Resort activities and experiences; and all other costs and expenses not expressly included in the Prize. Rooms, experiences, services, amenities and other offerings may be modified or unavailable, limited in availability or capacity, and subject to restrictions, change or cancellation without notice.
29. All members of the Group will be required to execute and return a waiver and release form (where allowed by law) prior to participation.
30. Prize winners may not charge any member of the Group for any aspect of the Prize.
31. Members of the Group are solely responsible for obtaining any and all necessary travel documents (valid photo I.D., credit card, passport, etc.) before departure. Any picture identification requirements associated with air travel are the Group members’ responsibility.
32. If any member of the Group is under the age of 18 (a “minor”), the prize winner or another member of the Group must be such minor’s parent or legal guardian.
33. No aspect of the Prize (and all elements thereof) is redeemable for cash or transferable except at the Sponsor’s sole and absolute discretion. The Prize may not be sold, separated, or transferred to any other person or third party. Any portion of the Prize which is not used, is forfeited. Prizes are provided “as is” with no warranty or guarantee, expressed or implied, being provided by the Sponsor, to the extent permittable under law.
34. The Prize may not be combined with any other offer, and travel may not qualify for frequent flier miles, award points or other perquisites. Lost or mutilated tickets will not be replaced. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades.
35. The actual value of the Prize awarded depends on a number of factors, including the location of the prize winner’s residence, booking and travel dates and the number of travellers, and therefore may be lower or higher than the approximate retail value at the time it is fulfilled. If the actual value of the Prize is less than the stated approximate retail value (“ARV”), the difference will not be awarded.
36. If any portion of the Prize is not available for any reason then the Sponsor reserves the right to substitute that portion of the Prize with another prize of comparable or greater value.
37. Officers, directors, and employees (and members of their household or immediate family, i.e., parents, children, spouse, siblings, grandparents, the “steps” of each and persons residing in such immediate family members' household) of The Walt Disney Company (Australia) Pty Ltd, their respective parent, related, affiliated and subsidiary companies, their advertising, promotion and web design agencies, all other entities involved in the creation, administration, or fulfillment of the OnePass – Shop, Stream. Win. with Sponsor and Target promotion and their respective successors and assigns are not eligible to enter or win.
38. Other than the Resort credit (which is valued in US dollars), prize values are in Australian dollars. Prize winners are advised that tax implications may arise from their prize winnings, and they should seek independent financial advice prior to acceptance of their prize.
39. The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the Competition result.
40. If a prize winner does not provide proof of meeting the age restriction and other valid entry requirements, the Prize will be forfeited in full, and the prize winner will have no further claim. A redraw will be held to award the Prize to a valid entrant.
41. Where relevant, it is the prize winners’ and their travel companions’ personal responsibility to ensure that they have valid travel and health documentation. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and their travel companions. The Promoter and the Sponsor makes no representation as to the safety, conditions or other issues that may exist at any destination.
42. There may be specific instructions and requirements for all visitors to Hawaii, which may include mandated quarantine or pre-travel testing. Each member of the Group is solely responsible at their own cost for staying updated on and complying with any of the latest advisories, restrictions and travel alerts that may be in place for travel to Hawaii leading up to the planned stay. Hawaii state requirements are subject to change.
43. Prizes will be awarded to the named subscriber who has signed up to the OnePass Disney+ Bundle subscription. Should a subscriber’s contact details change during the Competition Period, it is the subscriber’s responsibility to notify OnePass. A request to access or modify any information provided in the OnePass Disney+ Bundle sign up process, should be directed to OnePass.
44. Should the prize winner not meet any of the criteria stated in these terms and conditions to be a valid winner they will forfeit all rights to the Prize, and a redraw will take place to reallocate the Prize to a valid winner.
45. Unless expressly stated in these terms and conditions all other expenses related to the Prize become the responsibility of the winners. All costs associated with the Prize which are not expressly stated in these terms and conditions to be included, including but not limited to additional cost for food, beverage, and transportation.
46. The prize winners must provide valid identification to the Promoter upon the Promoter’s request. Failure to do so will result in the forfeiture of the Prize at the Promoter’s sole discretion.
47. Subject to state permit authority restrictions, the Promoter may reasonably amend these terms and conditions, orally or in writing, in its absolute discretion.
    
    Winner Generated Content & Publication
48. In participating in Competition, the prize winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The prize winners grant the Promoter and Sponsor a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the prize winners will not be entitled to any fee for such use.
49. The prize winners consent to having any content created during their stay to be used in Target, OnePass, and/or Sponsor channels or platforms.
50. The prize winners agree that they will not sell or otherwise make available their story and/or photographs to any media or other organization.
51. Force majeure
    If there is a force majeure event which prevents or materially and adversely affects the Promoter’s ability to market, promote and run the Competition in accordance with the Competition terms, the Promoter may cancel, terminate, modify, suspend or postpone the Competition subject to state and territory licensing authorities approval.
52. Liability
    Except as required under applicable law, neither the Promoter nor Sponsor is liable for any loss, expense, damage or liability suffered or incurred by entrants or winners in connection with the Competition, including:
    
    a. any late, lost, altered, damaged or misdirected information (when signing up to OnePass) or prize acceptance, including delays due to technical disruptions or network congestion;
    b. any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the Competition;
    c. any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure; and
    d. any theft, destruction, unauthorised access to or alteration of entries or the Prize; and
    e. any use of the Prize or any tax liability incurred by the winner as a result of accepting the prize; and
    f. any delay or failure relating to the Prize itself (including any negative encounter experienced by the winner and their travel companion/s, including but not limited to cancellation, changes or delays of flights or other transport arrangements, inclement weather or any illness experienced) or failure by any third party to meet any of its obligations in connection with a prize.
    
    Nothing under this clause 52 is intended to limit a Prize winners’ rights under the Australian Consumer Law 2010.
53. Privacy & Contact
    a. The Promoter collects personal information about entrants in order to run the Competition, communicate with you as the entrant to this Competition, administer and notify prize winners and prize fulfilment. The Promoter uses and manages entrants’ personal information in accordance with its OnePass Privacy Policy at https://onepass.com.au/privacy-hub/privacy-policy. The Promoter may provide entrants’ personal information to the Sponsor for the purpose of fulfilling a prize winner’s prize. Your personal information may also be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. The Promoter will also share de-identified information with third parties who support the Promoter in conducting the computerised draw, which include Ansible Pty Ltd and Universal McCann a division of Mediabrands Australia Pty Ltd and the Sponsor who will arrange travel and the fulfilment of the Prize for the winners. The Promoter will be unable to consider your entry into this Competition if you do not provide the personal information required in the sign-up process when you subscribe to a OnePass Disney+ Bundle subscription.
    b. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and postcode. If you do not want your information to be published, please contact OnePass Customer Support Team on 1300 026 710 during office hours. A request to access, update or correct any information should be directed to OnePass.
    c. All queries, issues and concerns in connection with this Promotion are to be directed to the Promoter by completing the Contact Us form at https://support.onepass.com.au/s/customer-support or by calling the Promoter’s Customer Support Team on 1300 026 710 during office hours. All disputes are to be adjudicated by the Promoter.
